Elm BakeAways terms and conditions

Please note we are a little homebased business and love nothing more than being part of your special day.

DEPOSIT:

Once you have decided you’d like Elm Bakeaway to cater for your event or make your cake you will need to pay an initial deposit which reserves your order, for the day you’ve specified. This is a non-refundable deposit. The remaining balance must be paid in full one week before delivery date or, in the case of Wedding Cakes, one calendar month before the specified date. Late or no payment is subject to cancellation. Late payments may result in substitutions or modifications to the original order as well as an additional charge.


Cancellations:
In the unfortunate event that you have to cancel your order you must give notice at least one week before this is subject to the size of the order. Cancellations made under one week of collection/delivery date will result in any monies paid not being refunded due to most items being purchased before that time.


General order collection/delivery:
Please be sure to schedule your pickup/delivery time accurately. If you feel that you are going to be later than planned, please contact us as soon as possible. In the event that you choose a time outside of your original pickup window, the new pickup time can and will be arranged at Elm BakeAways convenience. Failure to pick up an order the same day or to contact will result in your order being sold to another customer. Requesting to pick your order up at any other location than what is specified in the terms and conditions will be considered delivery, and will be subject to appropriate delivery fees. Travel charges will be made if delivery is farther than 5 miles from the Elm BakeAway kitchen.

Cake collection/delivery:

If you or your representative chooses to pick up and set up the cake, you assume all liability and responsibility for the condition of the cake or any other food products once it has left our possession. Elm BakeAway is not liable for damage due to client handling once the product has been picked up or delivered. If your product is damaged after it has been in your possession, we will assess the damages and may offer to fix the cake for you. If we come to you to fix the cake, mileage fees will be applied. Additional fees may also be applied, depending on the severity of the damage to the cake. If you have collected your cake from Elm BakeAway make sure your cake stays flat in your vehicle and that it is transported with minimal disturbance. No liability is accepted by Elm BakeAway if damage occurs in transit. All wedding cakes, without exception will be delivered to the agreed venue, set up and left, with a photograph sent to the customer at the point of leaving it there. Where possible Elm BakeAway will gain the signature of a responsible person to verify it has been left in immaculate order.


Designing your cake:
Cake design is a creative and organic process. Elm BakeAway will do our very best to replicate and create your selected design as closely as possible. However, at times, the cake designer must make adjustments to the design in the interest of structure stability or aesthetics, and will do so, without changing the design immensely. Design changes to the order may be made until 1 week prior to the specified date and will be charged accordingly.

Allergies:
Please be aware at the Elm BakeAway kitchen I use products that contain. Gluten (wheat), tree nuts, peanuts, eggs, soya, milk (dairy), mustard, sesame, celery, sulphates (found in dried fruit), lupine (can be found in bread, pastries and pasta).

While peanuts, other tree nuts or other allergens may not be a key ingredient in every one of our menu items, all our menu items are produced in the same area where products containing various nut items and allergens are created. Though best practices are used in the preparation of our menu items, inadvertent cross-contamination may occur.

Refunds:
A 25% non-refundable deposit will be required once the order is confirmed. This is to secure your date. The remaining amount will be due 14 days before the event date. In the event of a cancellation, please be advised that 75% of the total cost will be refunded up to 7 days prior to the event, 50% 72 hours prior and that there will be no refund if less than 72 hours’ notice is given.

A delivery charge may be added if the venue is further than 5 miles from the Elm BakeAway kitchen.


By paying the non-refundable deposit you are accepting and agreeing to the terms and conditions set forth in this agreement.
